Carrier’s Liability Insurance

In order to avoid financial losses, AsstrA insures its risks arising while servicing the company’s customers. The liability of the company as a freight forwarder is insured by the insurance broker, Basler Versicherung AG (Switzerland). Our cargo shipping liability is insured with a 1 000 000 EUR limit per every insured accident. Therefore, we guarantee compensation for damages caused by the freight forwarder.

In addition to carefully monitoring the quality of our carriers’ performance, we make sure that our subcontracted transportation companies dispose of a CMR policy.

However, not all damages of cargo are compensated by the carrier due to the fact that a carrier’s liability is limited by international and national law, including the CMR Convention.

According to the CMR Convention, the carrier is not liable for any damages arising from “handling, loading, shifting or unloading of the goods” (Article 17.4); or “through circumstances which the carrier could not avoid and the consequences of which he was unable to prevent” (Article 17.2), such as robbery (except in the case of rude neglect on the part of the driver), etc. The CMR Convention also sets the carrier’s maximum liability of 8,33 SDR (about 12 EURO) per 1 kg of the gross weight of the lost or damaged consignment. In such cases all losses are borne by the owner of cargo.

In order to avoid possible unpayable losses AsstrA recommends its customers to insure the cargo itself; this will guarantee a prompt recovery of full shipment value to its owner in the insurance case.
